Digital Business Ireland calls on government to clarify rules on open source projects EU AI Act

Industry body warns Act could stall innovation

Digital Business Ireland has called on the government to prioritise investment in open source AI both financiall and in the establishing of clear rules from the European Union in the upcoming AI Act.

The European Parliament in its version of the AI Act, the world’s first comprehensive AI law, has exempted open source AI systems from following the Act’s compliance rules, however, the it does not apply when open source AI is used for commercial purposes. 

Imposing regulatory obligations on open-source commercialisation is not an issue in itself, however, the current amendments seem to impose complex and unworkable conditions on open sourcing, which would severely discourage investors and start-ups in the space. 

DBI pointed to the success of France in it’s support of its native AI industry. In June, French President Emmanuel Macron announced €40 million in funding for French-made generative AI projects. The investment is intended to attract more capital from private investors.

On 14 June 2023, MEPs adopted Parliament’s negotiating position on the AI Act. The talks are currently underway with EU countries on the final form of the law, which is expected by the end of this year.

Established in 2019, DBI is comprised of a community of over 8,000 businesses and counts a number of national trade representative bodies, large technology companies and SMEs among its members. It is a member of the Dept of Enterprises’ Digital Advisory Forum.
